Chatters Contest Terms & Conditions

Chatters Limited Partnership (the “Contest Sponsor”) Giveaway contest (the “Contest”) begins on September 5, 2023 at 12:01 a.m. MST and is subject to ending at any time (the “Contest Period”).

Eligibility:

Eligible entrants must meet the following criteria:

• Legal residents of Canada (excluding the province of Quebec).
• Aged 18 or older as of the date of entry. If the entrant is under the age of 18in his or her eligible province of residence, they must provide the name and contact information of his or her legal parent or guardian in order to maintain eligibility.
• Hold a valid email address on the Draw Date.
• Be subscribed to the Contest Sponsor’s newsletter at the time of winner selection.
• SMS: If the entrant opts-in to give their SMS number they obtain an additional entry into the draw.

Employees, agents, or representatives of the Contest Sponsor and its subsidiaries and affiliates are not eligible to win, nor are the parents, siblings, and children of any such employee, agent or representative, or any person with whom such employee, agent, or representative is domiciled. A contestant that does not meet the requirements for eligibility will be automatically disqualified from the Contest.

The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. Void where prohibited.

Agreement To Rules:

By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Contest Sponsor as final and binding in all matters as they relate to the content of this Contest.

Entry Requirements:

NO PURCHASE NECESSARY

To enter the Contest, entrants must subscribe to either email or SMS or both.

• Entrants must be subscribed to email, SMS or both at time of giveaway drawing.
• Limit of one (1) entry per person that can be acquired through email subscription. If it is discovered that an individual has attempted to enter more than twice, whether using falsified information, fraudulent conduct, or other means, all of the individual’s entries will be void.
• The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion ofthe Contest Sponsor.

Prizes:

There will be a total of one (1) prize to be won during the contest period: a CDN $250.00 virtual gift card redeemable at Chatters.ca or any of the Contest Sponsor’s locations.

No cash or other prize substitution shall be permitted except at the Contest Sponsor’s discretion. The Prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for the Contest Sponsor to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Winner Selection:

The potential Contest winners will be chosen by random draw from among all eligible entries. Odds of winning depend on the total number of eligible entries to the Contest.

The draw is to be held 7 days after the contest period is closed “Draw Date.” One (1) eligible entrant will be randomly selected as the potential winner of the Prize outlined above.

The potential winner will be contacted by the Contest Sponsor through email. The potential winner must respond to the Contest Sponsor within forty-eight (48) hours to maintain their eligibility. If the potential winner does not reply to claim the Prize within forty-eight (48) hours of notification, another eligible entry may be selected, at the sole discretion of the Contest Sponsor, and the first potential winner will have no further claim to the Prize.

Privacy:

We use your personal contact information to administer this Contest, including contacting, announcing, and promoting prize winners. The Contest is run in compliance with the Contest Sponsor’s privacy policy, which may be found in full at www.chatters.ca/privacy-policy.

Terms and Conditions:

The Contest is subject to all applicable federal, state, and local laws and regulations. The Contest Sponsor reserves the right to cancel or modify the Contest or the Contest Terms & Conditions at any time without notice. The Contest Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Contest Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, the Contest Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Contest Sponsor. the Contest Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. The Contest Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability:

By entering, You agree to release and hold harmless the Contest Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

Disputes:

THIS CONTEST SHALL BE GOVERNED BY, ENFORCED UNDER AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE PROVINCE OF ONTARIO. As a condition of participating in this Contest, participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the Contest Sponsor having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

Imaraïs Beauty (the “Sponsor”) and Chatters Limited Partnership (the “Promoter”) Giveaway contest (the “Contest”) begins on May 16, 2024 at 12:30 p.m. EDT and is subject to end on May 31, 2024 at 11:59 p.m. EDT (the “Contest Period”).

Prize:  
By commenting on the Instagram post, you will be entered for a chance to win a flight for two and a two-night stay in Las Vegas to watch Sommer Ray preform at LIV Day Club on July 19th .

Eligibility:  
Eligible participants (“Entrants”) must meet the following criteria: 
- Legal residents of Canada (excluding the province of Quebec). 
- Aged 21 or older as of the date of entry.  
- Hold a valid passport to travel. 
- Employees, agents, or representatives of the Sponsor and Promoter and its subsidiaries and affiliates are not eligible to win, nor are the parents, siblings, and children of any such employee, agent or representative, or any person with whom such employee, agent, or representative is domiciled. A contestant that does not meet the requirements for eligibility will be automatically disqualified from the Contest. The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. Void where prohibited. 

Agreement to Rules:  
By entering this Contest, the Entrant agrees to abide by the Official Rules and Regulations and decisions. The Sponsor and Promotor reserve the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s and Promotor’s sole discretion. By entering this Contest, the Entrant agrees to accept the decisions of the Sponsor and Promotor as final and binding as it relates to the content of this Contest. 

Sponsorship: 
The Sponsor will conduct the Contest substantially as described in these Official Rules and Regulations. 

Winner:  
The Winner of the Contest (the “Winner”) will receive the prize outlined above. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all additional expenses related to the prize, including without limitation any and all local, provincial, state, and federal taxes. The Winner shall not transfer assignment of the prize nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor and Promotor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further consent or compensation unless prohibited by law.

The draw is to be held seven (7) days after the Contest Period is closed (the “Draw Date”). One (1) eligible entrant will be randomly selected as the potential winner of the Prize outlined above. The potential winner will be contacted by the Sponsor and/or Promotor through Instagram Direct Message. The potential winner must respond to the Sponsor and/or Promotor within forty-eight (48) hours to maintain their eligibility. If the potential winner does not reply to claim the Prize within forty-eight (48) hours of notification, another eligible entry may be selected, at the sole discretion of the Sponsor and/or Promotor, and the first potential winner will have no further claim to the Prize. 

Terms and Conditions:  
In its sole discretion, the Sponsor and Promotor reserves the right to modify, suspend, cancel, or terminate the Contest should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor and Promotor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Contest. Individuals who tamper with or attempt to tamper with the operation or entry process of the Contest or website or violates these Rules and Regulations will be disqualified by the Sponsor and/or Promotor in its sole discretion. 

Limitation of Liability:

Entrant further waives all rights to have damages multiplied or increased.
